What should I do if I’m arrested while visiting in Florida?
An arrest occurs once your freedom to leave has been eliminated or you are placed into custody. If you’re arrested for any crime while visiting Florida, make sure you immediately request to speak with an attorney and respectfully decline to answer any questions from the police. You are not required to sign any sworn statement and you should decline if you are asked to do so (especially in DUI and Theft cases). Remember, anything you say can be used against you in court.
You should answer only questions for purposes of the accident investigation. Once the police have completed the accident report and read you your rights, respectfully decline to answer any further questions without a lawyer present. In all other types of investigations, respectfully remain silent and ask to speak to an attorney.
Am I allowed to return to my home state after I am arrested?
Typically, you are allowed to return to your home state after being released after an arrest. Frequently, cases can be resolved without clients ever returning to Florida and appearing in court.
What happens to my bond?
Bonds paid for release from jail are either returned to the depositor or applied to fines and costs once the case is resolved.
